New Pathway to the Green Card Available Now.

Last week, the White House announced a sweeping new immigration program that will provide a pathway to the green card (“permanent residence”) for hundreds of thousands of people in the United States who do not have status. All individuals are eligible, including visa overstays, undocumented immigrants, border crossers, and more. Why, you ask?

The answer is simple: to keep U.S. Citizens and their undocumented spouses and children together.

Who is Eligible?

Any person in the United States without status is eligible. To qualify, one must:

  • Be in the United States without status (for any reason) when applying.
  • Have lived in the United States for at least ten (10) years as of June 17, 2024.
  • Be married a U.S. citizen no later than June 17, 2024.
  • Not have convictions for certain serious criminal offenses.

Also, stepchildren of a U.S. Citizen can apply if the stepchild is in the United States without status (for any reason) when applying and had a stepparent-stepchild relationship on or before June 17, 2024.

What Happens if Approved for the Program?

If approved for the program, the U.S. government issues an employment authorization document (work card) that is valid for three (3) years. Once the three (3) years comes to an end, a program participant can apply for permanent residence (the “green card”).

What to Do Now?

There is a very limited timeframe to apply. Also, the process is not simple and requires the submission of detailed applications and extensive supporting documents. This is something that you can do alone. An immigration lawyer with experience is necessary.
